  1. Introduction

    This Privacy Statement, effective as of August 1, 2023 provides information on the collection, use, sharing and processing of personal information by ArbStore, a service facilitating dispute resolution in cross-border trade, operated by ArbStore, SL a limited liability company domiciled in Spain, (“ArbStore”), the Data Controller.

    ArbStore has implemented technical and organizational measures to ensure the most complete protection of personal data processed through this website. This privacy statement is based on the EU General Data Protection Regulation (GDPR).

  2. Data collection and purposes of processing

    ArbStore collects and processes your personal information to conduct its services, to inform and make available products and services that may be of interest to you and for the development of web statistics. The information you provide will be used to contact you when necessary, e.g. to notify you about functionality changes to the web site and to offer services that you may find helpful (provided you have not opted out to receive such services); to respond to your requests, to and to comply with applicable laws such as to comply with an opt-out request.

    Our website collects a series of general data and information when a data subject or automated system calls up the website. This general data and information are stored in the server log files. Collected may be (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (so-called referrers), (4) the sub-websites, (5) the date and time of access to the Internet site, (6) an Internet protocol address (IP address), (7) the Internet service provider of the accessing system, and (8) any other similar data and information that may be used in the event of attacks on our information technology systems. When using these general data and information, we do not draw any conclusions about the data subject (i.e. you). Rather, this information is needed to (1) deliver the content of our website correctly, (2) optimize the content of our website as well as its advertisement, (3) ensure the long-term viability of our information technology systems and website technology, and (4) provide law enforcement authorities with the information necessary for criminal prosecution in case of a cyber-attack. Therefore, we analyze anonymously collected data and information statistically, with the aim of increasing the data protection and data security of our enterprise, and to ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files are stored separately from all personal data you may provide to us.

  3. Who will use the personal data?

    ArbStore will be responsible for the use of the personal data in respect of the ArbStore website.

    Where necessary – ArbStore will provide your personal data to the arbiter selected by you to resolve your dispute.

    Other than as described above, ArbStore will not sell, distribute or make available your personal data to third parties outside of its own organisation without your prior consent, unless obliged to do so under law, codes of conduct and professional practice or a court order.

    ArbStore will not retain your personal data longer than is necessary for the purposes described above, unless this data is necessary for complying with a statutory retention obligation, or (if longer) after the retention period under the applicable code of conduct and professional practice has expired. After expiry of the retention periods, your Personal Data will be deleted. If there is any information that we are unable, for technical reasons, to delete entirely from our systems, we will put in place appropriate measures to prevent any further use of the data.

  4. Legal basis for the processing

    Our basis for processing is the following:

    • In order to engage in transactions with our clients, suppliers and business partners, and to enable arbiters to resolve disputes you are involved with, we need to process information about you as necessary to enter into or perform a contract with you.
    • In order to comply with applicable laws and regulations, such as to comply with a subpoena or other legal process, or to process an opt-out request.

  5. Sensitive data

    ArbStore does not seek to collect sensitive personal data (such as data revealing political opinions, religious beliefs or data concerning health or sex life) through this site. If ArbStore does seek to collect such data, your prior consent will be asked. Please note that, by providing ArbStore with unsolicited sensitive personal data you consent to our using those data as described above.

  6. Security

    ArbStore has put appropriate technical and organisational measures in place in order to safeguard your personal data against loss or any form of unlawful use. Those persons who, on behalf of ArbStore, have access to your personal data, have a confidentiality obligation.

  7. International transfer of data

    Your data may be shared with specialized IT service providers. As such, your data may be transferred to countries outside the EEA. In such cases, personal data is transferred on the basis of declarations of adequacy or other appropriate safeguards, in particular standard data protection clauses adopted by the European Commission. Please contact us if you would like to request to see a copy of the specific safeguards applied to the export of your information.

  8. Your rights

    You have certain rights regarding your personal data, subject to local data protection laws. These may include the following rights:

    • to access your personal data held by us (right to access);
    • to rectify inaccurate personal data and ensure it is complete (right to rectification);
    • to erase/delete your personal data to the extent permitted by other legal obligations (right to erasure; right to be forgotten);
    • to restrict our processing of your personal data (right to restriction of processing);
    • to transfer your personal data to another controller to the extent possible (right to data portability);
    • to object to any processing of your personal data carried out on the basis of our legitimate interests (right to object). Where we process your personal data for direct marketing purposes or share it with third parties for their own direct marketing purposes, you can exercise your right to object at any time to such processing without having to provide any specific reason for such objection;
    • not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects ("Automated Decision-Making"). Automated Decision-Making currently does not take place on our websites;
    • to the extent we base the collection, processing and sharing of your personal data on your consent, to withdraw your consent at any time, without affecting the lawfulness of the processing based on such consent before its withdrawal.

    If you believe that ArbStore is not processing your personal data in accordance with the requirements set out in this Statement or applicable European EEA data protection laws, you can at any time lodge a complaint with the data protection authority of the EEA country in which you live or with the data protection authority of the country or state in which ArbStore has its registered seat.

  9. Cookies and log files

    ArbStore may gather and analyze information regarding usage of this web site, including domain name, the number of hits, the pages visited, previous/subsequent sites visited and length of user session. This information may be gathered by using a cookie. A cookie is a small unit of information which can be passed to your browser and placed on your hard drive while you are on the ArbStore website. You can choose to deactivate the use of cookies by altering the settings of your browser. If you have deactivated the cookies, it might have consequences for the ease of use of the ArbStore website.   10. Contract data

    We may collect information about your contracts and their performance only in case you or your counterparty appeals an arbiter’s resolution to the Arbstore. It remains private between you and your counterparty if no dispute is initiated. In case of a dispute, the arbiter chosen by you and your counterparty also gets the contract information. Arbiters’ treatment of your data is bound by this privacy policy, arbiter code of conduct, and arbiter listing criteria. We urge you to consult these documents before signing a contract.

  11. Third party sites

    Please note that this Privacy Statement does not extend to third party sites linked to this web site. ArbStore may include links to third party websites and these third parties or other parties present on these websites may gather information about you. ArbStore will not be responsible for the content of these websites or the actions of these third parties and other parties present on these websites. ArbStore recommends that you read their policies on the use of personal data.

    ArbStore and ArbStore’ logo and design are trademarks owned by ArbStore. All other company and product names are trademarks or registered trademarks of their respective holders, and are hereby acknowledged as such by ArbStore.
